Terms of Service

Welcome to Conflux. These Terms of Service ("Terms") govern your use of the Conflux mobile application and web application at confluxai.app (the "Service"), operated by TMediaDevelopment ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

Conflux is an AI chat application that allows users to interact with multiple artificial intelligence models and access various AI-powered features including text chat, image analysis, image generation, image editing, file upload and analysis, voice input, text-to-speech, translation, scheduled briefings, live sports data, semantic memory, compare mode (side-by-side model comparison), consensus mode (multi-model agreement), research reports, PDF export, and content reporting.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent to use the Service. By using Conflux, you represent that you meet these requirements.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials
You are responsible for all activity that occurs under your account
You must provide accurate information when creating your account
You must notify us immediately if you suspect unauthorized access to your account

4. Acceptable Use

You agree to use the Service in compliance with all applicable laws and these Terms. You may use Conflux for lawful personal and professional purposes.

5. Prohibited Content and Conduct

Zero Tolerance Policy: Conflux has zero tolerance for child sexual abuse material (CSAM) or any content that exploits or endangers minors. Violations will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.

You agree NOT to use the Service to create, upload, transmit, or solicit any of the following:

Child sexual abuse material (CSAM) or any content depicting the sexual exploitation of minors
Content that endangers, exploits, grooms, or harms minors in any way
Non-consensual intimate imagery of any person
Content that promotes, incites, or provides instructions for violence, terrorism, or self-harm
Content designed to harass, threaten, stalk, or intimidate any person
Content that promotes illegal drug manufacturing, human trafficking, or other illegal activities
Malware, viruses, or any code designed to harm or exploit systems
Content that infringes on intellectual property rights of others
Fraudulent, deceptive, or misleading content intended to scam or deceive others
Content that constitutes hate speech or promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
Spam or unsolicited commercial content

6. Content Moderation

To protect our users and comply with applicable laws, we employ automated content moderation systems to screen uploaded content, including images, files, and text prompts. We reserve the right to:

Block or remove content that violates these Terms
Suspend or terminate accounts that violate these Terms
Report illegal content and associated account information to law enforcement
Cooperate with law enforcement investigations
Retain content that may be relevant to a legal investigation

Moderation decisions may be made by automated systems and may not always be perfect. If you believe content was incorrectly flagged, you may contact us to request a review.

7. Images and File Uploads

When uploading images or files to the Service:

You must have the legal right to upload and share the content
Uploaded content may be screened by automated moderation tools before processing
Content is transmitted to third-party AI providers for analysis as part of the Service
You retain ownership of your uploaded content, but grant us a license to process it as needed to provide the Service
File uploads are limited to 5 files per message, with a maximum size of 10MB per file

You may report AI-generated content that you believe is inappropriate, harmful, or inaccurate using the in-app reporting feature. Reports are reviewed to improve content safety.

8. AI-Generated Content

Responses from AI models are generated by third-party providers and may contain inaccurate, incomplete, or biased information. You acknowledge that:

AI responses should not be considered professional advice (medical, legal, financial, or otherwise)
You are responsible for verifying any information provided by AI models
We do not guarantee the accuracy, reliability, or completeness of AI-generated content
AI models may occasionally produce harmful or offensive content despite safeguards
AI-generated images are subject to the same disclaimers as text content — they may be inaccurate, unexpected, or inappropriate despite content filters
Image generation is subject to daily usage limits; content policy violations may result in generation being blocked

9. Usage Limits

The Service may impose usage limits including daily message limits, image generation limits, and rate limiting to ensure fair access for all users. These limits may vary based on your subscription tier and are subject to change. Exceeding usage limits may result in temporary throttling or restricted access to certain features.

10. Third-Party Services

Conflux integrates with third-party AI providers to deliver responses. Each provider operates under their own terms of service and privacy policies. We are not responsible for the practices, content, or availability of these third-party services.

11. Intellectual Property

The Conflux application, including its design, code, features, and branding, is the property of TMediaDevelopment and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or reliability of any AI-generated content.

13. Limitation of Liability

To the maximum extent permitted by law, TMediaDevelopment shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless TMediaDevelopment from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, illegal activity, or for any other reason at our discretion. You may delete your account at any time by contacting us at support@confluxai.app.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the app or on our website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to conflict of law principles.
